Terms of Service

By accessing the Twixium AI platform (operated by Twixium AI Inc.), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

Twixium.ai is an AI automation agency serving local businesses. Our services include:

• AI-powered chatbots and virtual assistants
• Workflow automation and business process optimization
• Social media content creation and scheduling
• Analytics and performance insights
• Custom AI integrations and automation solutions

The Service is offered only to businesses and professionals acting for purposes related to their trade, business or profession. It is not offered to consumers. By subscribing, you confirm that you are acting on behalf of a business.

You agree to:

• Provide accurate and complete information
• Maintain the security of your account
• Comply with all applicable laws and regulations
• Respect intellectual property rights
• Not use the service for harmful or illegal activities

LUNA is an AI system. You must not configure or use LUNA to claim to be a human. Where the law requires it (including Article 50 of the EU AI Act), you must make sure the people LUNA talks with know they are interacting with AI. You are responsible for having a lawful basis and any required consents (including WhatsApp opt-in) for contacting your customers.

Subscription fees are billed in advance on a monthly or annual basis. You agree to:

• Pay all fees when due
• Provide valid payment information
• Notify us of payment method changes
• Accept automatic renewal unless cancelled

Prices do not include taxes. You are responsible for any VAT, GST, sales or similar taxes. If you are located in the EU or the UK, please provide a valid VAT number (at checkout or by writing to support@twixium.ai). Our supplies to you are then subject to the reverse-charge mechanism, and you are responsible for accounting for VAT in your country.

Our Data Processing Addendum forms part of these Terms and applies to personal data we process on your behalf. Our Privacy Policy explains how we handle your own account data.

The service and its original content, features, and functionality are owned by Twixium AI Inc. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

In no event shall Twixium AI Inc. be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms of Service or is harmful to other users, us, or third parties.

These Terms shall be governed by the laws of the State of Florida, without regard to conflict of law principles. For matters relating to the corporate governance of Twixium AI Inc., the laws of the State of Delaware shall apply. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Nothing in these Terms limits any rights that cannot be excluded under mandatory law.
